Emission Breaches relating to the incineration of waste

As stated on SEPA's Disclosure Log (F0150759) SEPA responded to a request asking for a summary of emission breaches relating to the incineration of waste at WID PPC plants. SEPA responded to a request for information under the Environmental Information (Scotland) Regulations 2004 in February 2010. Please refer to the link below to the released information.

West Carron landfill

As stated on SEPA's Disclosure Log (F0114653) SEPA responded to a request for information under the Environmental Information (Scotland) Regulations 2004 in September 2007. The request was for copies of records held by SEPA in respect of the licensing; any records held by SEPA or its predecessors in function, including correspondence relating to the disposal licence and the waste management licence and inspection and monitoring information, and any environmental information which SEPA holds, from whatever source, as to the suitability of the old licensed site to meet modern standards. The enquiry also sought copies of correspondence between SEPA and any other party consulted by SEPA (Falkirk Council) and for Internal Consultations in relation to the West Carron landfill site in general.

In 2010 SEPA received a request for information (F0164169) and subsequent Formal Review (F0168437) under the Environmental Information (Scotland) Regulations 2004. The request was for the current site license and any amendments made in the last six years; the complaints records for the site for the last six years; documents concerning any prosecution of the site operators in the last six years; any other documents such as notices and correspondence relating to action and threatened action by the Agency in the last six years; any notes, memos or reports relating to monitoring/site inspection/visits to the site in the last six years; and copies of all site inspection reports for the last six years relating to West Carron Landfill Site. Please note that the response to the original request (F0164169) withheld information within the date range 31 December 2009 – 2 September 2010.  At the date of the original request, enforcement action was ongoing with the proposal that a report be made to Procurator Fiscal.  Consequently information, within the scope of the original request, within the date range noted above was withheld under the terms of Regulation 10(5)(b) of the EIRs. On 1 November 2010, at a meeting of the Regulatory Review Team it was recommended that the report to the Procurator Fiscal should not be proceeded with.  

Further to the formal review (F0168437) information was redacted from a section of the released documents under the terms of Regulation 10(4)(e) of the EIRs, as the content consists of ‘internal communications’ by SEPA staff and details relating to the commercial operations of companies have been redacted in four documents under the terms of Regulation 10(5)(e) of the EIRs. In addition personal data relating to private individuals has been blanked out in accordance with Regulation 11(2) of the EIRs and the Data Protection Principles.   Also three documents were withheld under the terms of Regulation 10(5)(e) of the EIRs.  The information consists of a report and two documents containing commercial costings for activities. SEPA considers that the information is commercial in nature and can confirm that the information not publically available, at this time.

Chief Executive and Directors expenses claims

SEPA received a request for information under the Freedom of Information (Scotland) Act 2002 for copies of all expenses claims and receipts filed by the chief executive and senior directors in the last three years (2007, 2008, 2009). The attached files contain the copies of the claim forms submitted by SEPA directors for the calendar years 2007, 2008 and 2009.

Chief Executive Expenses

SEPA received a request for information under the Freedom of Information (Scotland) Act 2002 for details of all expenses claimed by the Chief Executive 01 Jan 09 to 31

Jan 2010. The attached file contains the requested information. All flights taken by the Chief Executive were booked via the SEPA Travel Desk and were not the subject of expenses claims. No expenses claims were submitted by Dr Gemmell for January 2009.

Tender for the Historic Flood Events Pilot Project

SEPA received a request for information under the Environmental Information (Scotland) Regulations 2004, for all information relating to the evaluation process for the assessment of the Tender for the Historic Flood Events Pilot Project. Attached are 15 emails and eight documents which fall within the scope of the request, including; a blank template of the Evaluation Matrix spreadsheet and three subsequent versions of the matrix, the transmittal emails, a set of handwritten notes made by a member of the Tender Panel, and three drafts of a report prepared by the Project Manager for the Flooding project.

Faslane and Coulport.

As stated on SEPA's Disclosure Log (F0129031) SEPA has received a request for information under the Environmental Information (Scotland) Regulations 2004 concerning any reports, memos, correspondence or other documentation relating to safety or the environment regarding Faslane and Coulport, including the Oil Fuel Depot at Faslane and any handling of radioactive waste on a primary effluent barge in Gareloch (last 12 months) (held by specific members of SEPA staff (not information held by the Environmental Protection and Improvement team)).

SEPA has received several requests for information under the Freedom of Information (Scotland) Act 2002 and the Environmental Information (Scotland) Regulations 2004 concerning correspondence between SEPA, CNPA, the Scottish Government, and the developers concerning the planning applications as discussed on the 14th December 2007 regarding Aviemore Highland Resort Ltd. Can you also send follow-up letters from Sepa requiring implementation plans to meet the issues identified?
