Transfrontier shipments
Introduction
The Transfrontier Shipment of Waste Regulations 2007 (TFS) came
into force on 12 July 2007.
The Regulations amended Section 41(1) of the Environment Act
1995 (power to make schemes imposing charges) such that SEPA and
other UK Competent Authorities can recover the costs incurred when
performing functions conferred by the Regulations.
Costs to be recovered include administrative costs incurred when
implementing the notification and supervision procedures of the
community regulation and costs of any analyses or inspections
undertaken for the purpose of carrying out their functions under
that regulation.
Fees and charges are set out in Schedule 2 of the regulations.
Such charges will be in effect until a charging scheme under
section 41 of the Environment Act 1995 to recover such costs takes
effect or until 1 April 2011, whichever is earlier.
Fees must be paid by the notifier when submitting a notification
and the competent authorities may refuse to proceed with a
notification unless the required fee is submitted.
Schedule 2: Transitional fees in Scotland
There is one charge per notification which is payable when the
notification is made.
The charge depends on:
- whether the waste is being imported or exported to/from England
or Wales;
- the purpose of the shipment, whether it is for recovery or
disposal;
- the band into which the number of shipments included in the
notification falls.
