Consultation on proposed resource recovery facility near Stonehouse, South Lanarkshire

The Scottish Environment Protection Agency (SEPA) has received an application for a permit under the Pollution Prevention and Control (Scotland) Regulations 2000 from Scotgen (South Lanarkshire) Ltd
to operate an incinerator plant on land adjacent to Carlisle Road, Near Stonehouse, South Lanarkshire.

SEPA served a Notice for Further Information
(521 kb) to Scotgen (South Lanarkshire) Ltd on 16 September 2011, asking 44 questions. Some questions had a deadline of 21 January 2012 with the remainder having a deadline of 31 July 2012.
SEPA have now received a response letter
(87 kb) with information from Scotgen answering 33 of the 44 questions asked. The answers mainly address aspects of atmospheric dispersion modelling and noise impact assessment. All documentation received can be viewed in the table below.

Following the outcome of the Judicial Review into South Lanarkshire Council’s planning procedures, it is anticipated that the remaining information will be submitted before the 31 July 2012 deadline. Should the applicant not submit all the information required by 31 July 2012, SEPA may deem the application to have been withdrawn.

The application has been posted on our website for public consultation. The company indicated that the original application was advertised in the Edinburgh Gazette on 10 June 2011 and the Hamilton Advertiser on 16 June 2011 which meant the closing date for representations was midnight on Wednesday 13 July 2011.
SEPA has four months, plus any time required to seek further information, to determine this application. As part of the determination process, SEPA seeks the views of statutory consultees such as South Lanarkshire Council, the Food Standards Agency, Scottish Natural Heritage and Lanarkshire Health Board, as well as members of the public.

Judicial review
Q What will happen to the application submitted to SEPA for the material recycling facility at Dovesdale now that an appeal against the planning permission decision is being taken to judicial review?
A. We are aware that the planning consent granted by South Lanarkshire Council has been challenged and is due to be heard in the Court of Session later this year. This does not prevent the receipt and determination of an application for a permit to operate that activity but we cannot grant a permit unless planning permission is in place for the use of the relevant land for that activity. If our determination is that a permit should be granted, we cannot grant it until planning permission is in place.
