Pollution prevention and control (PPC) application forms
Introduction
Permit summary
These are environmental permits granted for activities discharging to the environment including the management of waste. They are issued by the Scottish Environment Protection Agency and the conditions in the licence must be complied with by law.
Eligibility criteria
Whether or not you are granted a licence will depend on a number of factors such as whether the activity complies with the environmental controls needed to protect the environment in Scotland. If you wish to discuss an application, please contact the local SEPA office nearest to your site.
Regulation summary
The relevant regulations are the Pollution Prevention and Control (Scotland) Regulations 2000 which are there to protect Scotland's environment. Guidance can be found in the Pollution Prevention and Control (Scotland) Regulations 2000 - A Practical Guide 
Application evaluation process
- For some applications, SEPA may ask you to advertise your application to allow local interested parties to engage in the licensing process.
- SEPA may seek to issue a draft licence for consultation under the EU Public Participation Directive.
- Evaluation of the application will consider a range of environmental factors and whether operator is a fit and proper person to hold the licence.
Tacit consent
Tacit consent does not apply under PPC. There are however clearly defined requirements for the application process.
The PPC Regulations set down statutory periods following receipt of an application within which SEPA will normally reach a decision. These are as follows:
- A new permit application - four months.
- An application for a variation - four months if consultation is undertaken under the terms of the PPC Regulations and three months in other cases
- Application for a transfer - two months
- An application for surrender - three months.
These periods exclude the time taken for the Operator to respond to any additional requests for information after application submission. In complex cases, SEPA and the Operator may agree that a longer decision period is appropriate. However, the Operator does not have to agree to this and may appeal to the Scottish Ministers if SEPA does not provide its decision in the period specified by the Regulations. Redress
Where applicants and operators do not agree with the conditions and requirements imposed by a PPC authorisation or notice, an appeal can be made to Scottish Ministers. The submission of an appeal does not suspend the operations of all authorisations or notices and its conditions.
