Compliance Scheme Update – presentation by Jennifer Leonard (SEPA)

There will be a stakeholder workshop day on 7th May – please contact Fiona for a place, or to volunteer to be part of external trials in summer 08.

Scheme will cover Part B sites, but may not affect Pt B charges. Initially, effect on charges for Pt A’s may only be in 3 bands rather than 5, and amount of effect likely to be small.  Current proposal is not to have separate appeals process – any appeals would be dealt with via SEPA’s formal complaints procedure – RR queried if involvement of public ombudsman would be appropriate for this?

Scheme will be rolled out for PPC, CAR, RS, WML at same time (not CAR engineering or COMAH) and will feed into charges during reviews of charge schemes for each regime.

JL requested feedback on any aspect on scheme, but in particular:

Is use of 100% ELV exceedance appropriate to define ‘Major/ Significant’ event?

Is ‘4 or more’ appropriate to be classed as ‘repeated minor breaches’?

MG raised issue of compliance against direct/ indirect/ surrogate ELVs – all treated same?

PL raised issue of site addresses etc being published on website, w.r.t security issues at farms

DF asked that operators see proposed details of attributes to be used for scoring for their sites – issue of repeated minor breaches at very large sites

Any comments to be sent back to FW by 21/3/08. Draft can be circulated to member companies.

Charging Scheme Review:

PL had not received consultation for Phase 1 amendments – JS to resolve. Also query on why surrender fee payable if site not closing, just dropping below Part A threshold. JWB response that SEPA still had to consider satisfactory state etc.

JS gave presentation on main proposed changes

RR said proposals would be put to Ministers for approval shortly for revised scheme to come into force on 1 April 2008

IPPC Directive Review

IH gave presentation on main proposed changes, e.g. BAT standards to be those in BREFs, changes to Annex 1(activities covered). Changes would take effect from 1/1/11 to transpose into national legislation by 30/6/12. SEPA currently collating internal comments, and will feed corporate view to Scottish and UK Govts.

Trade Associations can make responses to Scot Govt or Defra, or to the European Commission direct if they have links to European trade associations. Defra chairs the UK IPPC Sounding Board for receiving representations from industry on IPPC issues.  Defra contact details are
