The planning system regulates the location of developments and the control of operations in order to avoid or minimise adverse effects on the use of land and on the environment (including groundwater) and to secure restoration to a condition capable of the agreed after-use.
Local Authorities have delegated powers to act as Planning Authorities and are responsible for enforcing planning controls. SEPA is consulted by the planning authority on local and structure plans as well as planning applications received for specific operations such as mining. Amendments to this Act are expected in 2006.
