Special sites in Scotland

  • The Former Oil Refinery, Old Kilpatrick

    This site is at grid ref: NS 470 718. It is currently vacant/derelict but was formerly a petroleum processing site; it is 16 Hectares in size and is jointly regulated by West Dunbartonshire Council and SEPA.

    STATEMENT from the SCOTTISH ENVIRONMENT PROTECTION AGENCY

    Special site confirmed in West Dunbartonshire Council area

    In November 2004 the Scottish Environment Protection Agency (SEPA) received notification from West Dunbartonshire Council of a designation of a special site on land the Council had previously identified as contaminated land under Part IIA of the Environmental Protection Act 1990.   SEPA was not in full agreement with the designation and in December 2004 the case was referred to the Scottish Executive for determination.  On 14 July 2006 the Scottish Executive notified both West Dunbartonshire Council and SEPA that it has decided not to uphold the original special site designation for the whole site, however, part of the site has been determined to be a special site. The designation of the land as a special site therefore takes effect, and SEPA is now the enforcing authority for Part IIA at part of the site.

  • Site of Pelikan Hardcopy Scotland Ltd, Turriff, Aberdeenshire, AB53 4AW

    This site is located at grid ref: 372830 850450. The site is 4.4 hectares in size and is currently occupied by an operational manufacturing site at which a Part A PPC installation, also regulated by SEPA, operates.

    STATEMENT from the SCOTTISH ENVIRONMENT PROTECTION AGENCY

    Special site confirmed in Aberdeenshire Council area

    On 21 October 2005, the Scottish Environment Protection Agency (SEPA) received notification that Aberdeenshire Council had decided to designate as a special site, land the Council had previously identified as contaminated land under Part IIA of the Environmental Protection Act 1990. SEPA can confirm it has notified the Council that it agrees with the designation. The designation of the land: the site of Pelikan Hardcopy Scotland Ltd, Turriff, Aberdeenshire, as a special site therefore takes effect, and SEPA is now the enforcing authority for Part IIA at the site.

  • Tesco Dry goods distribution centre, Dundee

    This site is located at grid ref: NGR: 33794 73266. The site is approximately 3.7 hectares.

    STATEMENT from the SCOTTISH ENVIRONMENT PROTECTION AGENCY

    Date: FRIDAY 20TH June 2008

    Special site confirmed in Dundee Council area

    On 10th and 20th June 2008 SEPA received notification from Dundee City Council of the designation of a special site on land the council has identified as contaminated land under Part IIA of the Environmental Protection Act 1990.  On 30 June 2008 SEPA responded to Dundee City Council stating that it agrees with the designation.

    The designation of the land* as a special site therefore takes effect and SEPA is now the enforcing authority for Part IIA at the site.   • Whitelees Road , Lanark

This site is located at grid ref: NS 90004 43551. The site is approximately 2.2 hectares in size.

STATEMENT from the SCOTTISH ENVIRONMENT PROTECTION AGENCY

Special site confirmed in South Lanarkshire Council area.

On 4 October 2011 SEPA received notification from South Lanarkshire Council of the designation of a special site on land the council has identified as contaminated land under Part IIA of the Environmental Protection Act 1990.  On 2 November 2011 SEPA responded to South Lanarkshire Council stating that it agrees with the designation.

Public registers established under Part llA

Local authorities and SEPA are required to establish public registers under Part IIA. The Act and Regulations specify what information is to be made available in public registers, subject to exclusion on the grounds of national security and commercial confidentiality. The public register will contain particulars relating to the remediation of contaminated land, as well as notifications of the identification of contaminated land and the designation of special sites. The public registers will become populated with information as land is identified as contaminated. In time they will provide an indication of the extent remediation carried out under Part IIA. SEPA's Part IIA public register will only contain particulars relating to special sites, whilst local authority Part IIA registers will contain particulars relating to contaminated land and special sites in their area

Part llA State of Contaminated Land Report

SEPA is required by the Act to prepare and publish a report on the State of Contaminated Land in Scotland, based on information supplied by local authorities, and as directed by Scottish Ministers. The aims of the report are to:

  • to compile information on the general nature, extent and distribution of land identified as contaminated under Part IIA
  • to assess the scale of the environmental impact of contaminated land and highlight where Part IIA is reducing this impact
  • to summarise regulatory activity under Part IIA, in particular identification and remediation of contaminated land
  • to assess the effectiveness of Part IIA in addressing contaminated land, in particular the impact of the reasonableness and hardship provisions on remediation

The report will focus on two key stages of Part IIA: the identification of contaminated land and the remediation of contaminated land. The emphasis on each stage will obviously vary for each report issued.

Scottish Vacant and Derelict Land Survey (SVDLS)

The Scottish Vacant and Derelict Land Survey (SVDLS) covers vacant land in, or close to, urban areas and derelict land in both urban and rural areas. Derelict land is that which has been so damaged by development or use that it is incapable of being developed for beneficial use without rehabilitation. Vacant land is that which is unused or unsightly or which would benefit from development or improvement. The survey provides an indication of the contamination of vacant and derelict land. The term 'contamination' refers simply to suspected or known presence of potential contaminants and therefore differs from the statutory Part IIA definition.

The first SVDLS was carried out in 1990 following a successful pilot survey in 1988. It is now undertaken annually and records the extent and characteristics of vacant and derelict land, as well as land brought back into beneficial use. The survey is a collaborative exercise by The Scottish Government and the planning authorities. The results are published annually in a Scottish Government Statistical Bulletin. State of the Environment: Scotland's Soil Resource

The report considers various issues relating to soil as resource, and land contamination is just one of these issues. It therefore provides an overview of soil quality, rather than providing an indication of the extent of contaminated land in Scotland.
