Special sites
The Regulations as ammended provide for the designation of a
sub-set of contaminated land as special sites. A special site is
contaminated land which meets one of the descriptions in the
regulations, for example land on which a process subject to
Integrated Pollution Control is, or has been, operated. The
Regulations as ammended should be referred to for further
information. Special sites do not necessarily represent the most
heavily contaminated land. Special site designation is the
responsibility of local authorities, who are required to seek
advice from SEPA. Once a special site has been designated as such,
SEPA becomes the enforcing authority. Local authorities remain the
enforcing authority for all other statutorily contaminated
land.
