Waste Management Licensing etc (Fees and Charges) (Scotland) Scheme 1998

This Notice is published by SEPA under section 42 of the Environment Act 1995 ('the Act') to bring to the attention of persons likely to be affected by the proposed Waste Management Licensing Etc (Fees and Charges) (Scotland) Scheme 1998 ('the Scheme') the proposed provisions of the Scheme.

SEPA intends to use its powers under S.41 of the Environment Act 1995 to make the Scheme which is intended to come into effect on 1 April 1998. It is proposed that the Scheme will be based on the Waste Management Licensing (Fees and Charges) (Scotland) Scheme 1997 subject to the following changes:

1. Changes in Fees

SEPA proposes to increase ALL charges by approximately 20% but intends to retain the 15% relief for small businesses for a further year.

2. Refunds of Subsistence Charges.

SEPA proposes to introduce a provision for the pro - rata refund of paid subsistence charges where licences are surrendered during the financial year.

3. Ending of Transitional Provision for 'New Special Waste'

SEPA proposes to end the transitional provision for 'new special waste', but to retain lower charge rates in respect of sites where the only special waste accepted is 'bonded asbestos'.

4. Charges for 'Civic Amenity Sites'

SEPA proposes to make it clear that the charges for 'civic amenity sites' only apply to sites operated by local authorities.

5. Calculation of Combined Subsistence Charge for Adjoining Sites

SEPA proposes to amend the provision covering the calculation of subsistence charges for adjoining sites to allow the charge to be calculated on a separate or combined basis and thus to levy the minimum charge.

6. Increases in Fees for Registration of Carriers and Brokers of Controlled Waste and Exempt Scrap Metal Dealers and Vehicle Dismantlers

SEPA proposes to include into the Scheme the fees for registration of carriers and brokers of controlled waste and the registration of exemptions and annual inspections of scrap metal dealers and vehicle dismantlers. It is proposed to increase the existing fees by approximately 20 %.
