At Dundee Sheriff Court, on 28 November 2001, Rockwell Solutions Limited pled guilty to a charge under section 23(1)(c) of the Environmental Protection Act 1990, in that they failed to comply with the requirements imposed by an enforcement notice served under section 13 of that Act within the time limits specified.
Rockwell Solutions Ltd operates a flexible printing process at Wester Gourdie Industrial Estate, Dundee, which is prescribed for control by SEPA. Rockwell Solutions Limited were fined £5,000.
Essentially, it related to a failure by the company to install an abatement system to remove solvent from their emissions to air which should have been in place by December 1998.
Colin Anderson SEPA Dundee Team Leader said: "SEPA welcomes the outcome of this case. It should serve as a warning to any company which tries to delay installing abatement equipment necessary to protect the environment.
“Companies are made aware of the need to upgrade their plants well in advance of any regulatory deadlines and it is their responsibility to ensure that this work is carried out on time. Although most companies adopt a very responsible attitude to this, SEPA has made it clear through its actions in reporting this case to the Proculator Fiscal, that we will take firm enforcement action when needed.”
