At Selkirk Sheriff Court on 31 October 2000, John Nixon trading as Scottish Bait Services pled guilty to a breach of an odour condition contained in an Authorisation granted by SEPA in respect of his maggot breeding process at Charlesfield Industrial Estate,St Boswells. This breach was contrary to sections 6(1) and 23(1)(a) of the Environmental Protection Act 1990 . Sentencing was deferred on several occasions, but on 25 September 2001 he was admonished by the Sheriff.
SEPA reported Mr Nixon to the procurator fiscal following separate substantiated incidences of offensive odour detectable outwith the process boundary of his maggot farm, all in breach of his Authorisation.
