The Scottish Environment Protection Agency has welcomed the conviction of Dundas Brothers Ltd of Kintore for failing to comply with environmental legislation. At Aberdeen Sheriff Court today the company was fined a total of £20,000 for two charges relating to enforcement notices served by SEPA under the Environmental Protection Act 1990.
Following a prolonged period of public complaint relating to offensive odours from the site and failure by Dundas Brothers Ltd to comply with its authorisation, SEPA issued two enforcement notices. The company failed to comply with these and SEPA sent a report to the procurator fiscal.
SEPA’s Director of Operations, Willie Halcrow, said: “We’re pleased that the company has been fined an appropriate amount for this serious and long-running case of non-compliance.”
Stewart Mitchell, of SEPA’s Aberdeen office, added: “This site has been a significant concern for some time. We will continue to work with the company to improve the situation, but as this case shows we will not hesitate to take strong enforcement action if we are not satisfied with the progress.”
