On Wednesday 30 July 2003 at Arbroath Sheriff Court, D Geddes (Contractors) Ltd pled guilty to causing suspended solids (soil) to enter controlled waters, namely the Monikie Burn on 8 May 2002 contrary to section 30F(1) of the Control of Pollution Act 1974 (as amended).
The Company was admonished by the court.
The prosecution was the result of a report submitted to the Procurator Fiscal after SEPA officers received a complaint regarding discolouration of the Monikie Burn, by Carnoustie. The Company had constructed a temporary culvert and bridge for vehicles crossing the Burn from metal pipes and soil instead of hardcore material and the soil was washed into the Burn.
Stuart McGowan, Senior Environmental Protection Officer with SEPA, said “The Company has advised that it will liaise with SEPA in the future regarding their operations. However this pollution incident could have been avoided had SEPA's advice been sought about the proposed operation.”
