Scottish Water pled guilty at Airdrie Sheriff Court on 9 December 2003 to causing or knowingly permitting sewage effluent to be discharged into the Red Burn by way of a pipe serving Dunnswood Waste Water Treatment Works contrary to section 30F(3) of the Control of Pollution Act 1974.
Scottish Water was fined £4,000.
On 19 March 2003 operational problems at Dunnswood Wastewater Treatment Works, Cumbernauld, resulted in sewage sludge being discharged to the watercourse. The incident caused the Red Burn and Bonny Water to turn grey for several kilometres downstream and also resulted in sewage solids being deposited on the bed of the watercourse.
Andy Hemingway, SEPA Environmental Protection Officer who investigated the case, said: “SEPA is satisfied with the outcome of this case. We work with organisations to prevent pollution occurring but in this case there was a breach of the consent standards which are designed to prevent or minimise pollution of the water course.”
