At Kirkcaldy Sheriff Court on the 12 December 2003, local Glenrothes company, System Homes Ltd, pled guilty to disposing of controlled waste by burning on land at Foresters Grove building site, Glenrothes. The company were fined £10,000. Controlled waste was burned at the site on seven occasions between January and October 2002. The prosecution was the result of a report submitted to the Procurator Fiscal by the Scottish Environment Protection Agency (SEPA).
SEPA officers received several complaints of fires at the Forester’s Grove site between January and October 2002. SEPA officers visited the site and witnessed evidence of burning controlled waste on a number of occasions. The officers witnessed polythene sheeting, polystyrene pipe insulation, timber off cuts, plasterboard, timber sheeting, aerosols, metals, electric cable, paper and cardboard being burned at the site. Generally it is illegal to dispose of controlled waste by burning it. Legal means of disposal include disposal at a landfill site, with payment of appropriate fees. SEPA officers attempted to work with the company to stop the burning but the company continued to burn waste at the Foresters Grove site.
Lindsay Younie, SEPA Environment Protection Officer for the case, said: “SEPA is pleased with the level of fine imposed by the Sheriff. We hope that the outcome of this case will highlight the cost of illegal disposal of waste and act as a deterrent for other businesses planning the same practice.”
