Scottish Water pled guilty at Dunfermline Sheriff Court, on Tuesday 23 December 2003 to two charges of causing or knowingly permitting sewage effluent to be discharged to controlled waters, namely the Torry Burn.
The first charge related to an incident on 24 March 2003 when sewage effluent discharged into the Burn from a vent pipe in a private garden at 104 Main Street, Cairneyhill and a manhole in an adjacent lane, as a result of a blockage in the main foul sewer. Scottish Water were fined £1,000 in respect of this charge.
The second charge related to an incident on 15 May 2003 when sewage effluent discharged into the Burn via an outlet from the surface water pumping station at Drummormie Road, Cairneyhill as a result of an overflow from the foul sewerage system into the surface water system. Scottish Water were fined £3,000 in respect of this charge.
Carolyn Lumsden, Environment Protection Officer for SEPA Stirling Team, said: “SEPA is satisfied with the outcome of these cases. We work with organisations to prevent pollution occurring but these two incidents took place within a 50 m stretch of the Torry Burn in a residential area and caused severe, although temporary, downgrading of the burn”
