Producers
If your company carries out one of the following
activities, you will need to join a Producer Compliance
Scheme.
- Manufactures and sells electrical and electronic equipment
(EEE) under their own brand
- Resells, under its own brand, equipment manufactured by other
suppliers (this does not apply if the equipment still bears the
brand of the manufacturer when placed on the market)
- Imports electrical and electronic equipment on a professional
basis into the UK.
The Regulations require any 'producer' (manufacturer,
re-brander, or importer) of EEE to finance the costs of collection
and treatment of waste electrical and electronic equipment (WEEE)
that arises over a calendar year, in proportion to the amount by
weight they place on the market. Once a producer joins a scheme, it
is the scheme that takes on the legal obligation on the producer's
behalf.

required to supply data in respect of the amount of EEE you have
placed on the market, and pay a registration fee.

Please note that the WEEE regulations apply to all
producers regardless of their size, turnover, market share or
number of employees.
There are a number of categories recognised under the
regulations that an electrical product can fall into, and there are
also a number of exemptions. The attached 'Decision Tree'
helps us define the nature of your product which will affect your
market share, or if your product is exempt from the
regulations. However, the final decision on categorisation
and exempt status lies with SEPA.
