ABSTRACTIONS
General Registration Conditions (Abstractions)
| 1. |
Other than as specifically permitted or limited by any
condition of this authorisation, the authorised activities shall
not have a significant adverse impact on, or cause pollution of,
the water environment. |
| 2. |
There shall be a means of demonstrating that the abstraction is
within the registered daily volume limit, such as a means of
measuring the rate of the abstraction or a means of demonstrating
that the maximum volume that could be abstracted cannot exceed the
registered daily volume limit in any one day. |
| 3. |
Water leakage shall be kept to a minimum by ensuring all pipe
work, storage tanks and other equipment associated with the
abstraction and use of the water are maintained in a state of good
repair. |
DISCHARGES
General Registration Conditions (Discharges)
| 1. |
Other than as specifically permitted or limited by any
condition of this authorisation, the authorised activities shall
not have a significant adverse impact on, or cause pollution of,
the water environment. |
| 2. |
The effluent treatment system shall be maintained in accordance
with the manufacturers or designer’s recommendations, and in any
event, in good working order. |
ENGINEERING
Note: Prior to the commencement of works, you
are advised to consult the owners of any private drinking water
supplies in the vicinity and assess the potential impact of the
proposed works on those private drinking water supplies.
General Registration Conditions (Engineering)
| 1. |
Other than as specifically permitted or limited by any
condition of this authorisation, none of the Authorised Activities
shall have a significant adverse impact on, or cause pollution of,
the water environment. |
| 2. |
All reasonable steps shall be taken to prevent the transport of
sediments or other matter disturbed by the Authorised Activities
into waters beyond the worked stretch. |
| 3. |
The Authorised Activities shall not destabilise the bed or
banks of the inland surface water. |
| 4. |
Vegetation shall be removed only to the extent necessary to
carry out the Authorised Activities. Any vegetation that is
removed shall not be disposed of into any inland surface
water. |
| 5. |
The Authorised Activities shall not prevent the free passage of
migratory fish. |
| 6. |
The Authorised Activities must be carried out so as not to
cause a restriction to flood flow, and/or exacerbate the risk of
flooding on or off-site. |
| 7. |
Where a temporary bridge or culvert is installed to facilitate
the Authorised Activities, the culvert shall not extend more than
10 metres along the length of the inland surface water and shall be
removed on completion of the Authorised Activities. |
| 8. |
Where an area of inland surface water is isolated in order to
carry out the Authorised Activities, e.g. by over pumping, the
isolated area shall cover as small a surface area as possible and
the watercourse shall be returned to the original channel as soon
as possible after completion of the Authorised Activities.
(i) The inflow to any pumps used shall be screened so as to
ensure that fish are not drawn into the pump during its
operation.
(ii) Open channel diversions shall not be used. |
| 9. |
Any vehicle, plant or other equipment shall only operate in
water where it is impracticable for it to operate on dry land. |
| 10. |
If any vehicle, plant or equipment enters the water for the
purposes of carrying out the Authorised Activities, all reasonable
steps shall be taken to minimise damage to the bed and banks of the
surface water. |
| 11. |
Vehicles, plant or other equipment shall not be operated in an
inland surface water during periods in which fish are likely to be
spawning in that inland surface water nor during the period between
any such spawning and the subsequent emergence of the juvenile
fish; and |
| 12. |
Any vehicle, plant or other equipment shall not operate in
water where there is a reasonable likelihood that, within 50 metres
of such an operation, there are freshwater pearl mussels. |
| 13. |
Any vehicle, plant or other equipment used in or near surface
waters shall not leak any oil. |
| 14. |
Unless condition O below applies, the refuelling and washing of
any vehicle, plant or other equipment shall be undertaken at least
10 metres from any surface water or any groundwater abstraction
point, and run-off from such washing shall not enter any surface
water. |
| 15. |
Any static plant or equipment used within 10 metres of surface
water shall be positioned on a suitably sized and maintained
impervious drip tray with a capacity equal to 110% of the capacity
of the fuel tank. |
| 16. |
None of the authorised activities shall have a significant
adverse impact on private drinking water supplies. |
Additional conditions for Removal of a Registration-level
structure
| 17. |
The banks and bed of the watercourse shall be re-instated at
least to the equivalent condition of the bed and banks of the
watercourse in the immediate vicinity of the site from where the
structure was removed. |
| 18. |
Bank re-profiling shall not result in the heightening of either
bank or the widening, or narrowing, of the channel width. |
| 19. |
Areas of bare earth on re-profiled banks shall be
re-established with an appropriate mix of native riparian
vegetation or lined with a biodegradable geotextile. |
| 20. |
For removal of a bridge, bridging culvert, pipe/cable crossing
or bed reinforcement, the Authorised Activity shall not be
undertaken during periods in which fish are likely to be spawning
in the watercourse nor in the period between any such spawning and
the subsequent emergence of the juvenile fish. |
IMPORTANT INFORMATION
If your activity is registered, it will require to be carried
out in accordance with the terms of the application, and the
conditions detailed above. To contravene the terms of the
application or the conditions would constitute an offence under
regulation 44 of the Water Environment (Controlled Activities)
(Scotland) Regulations 2011.
It is an offence under regulation 44 of the Water Environment
(Controlled Activities) (Scotland) Regulations 2011 to make a
statement which you know to be false or misleading in any material
particular, or recklessly make a statement which is false or
misleading in any material particular for the purpose of obtaining
a registration (for yourself or anyone else) or seeking a variation
of a registration.
THE DATA PROTECTION ACT 1998
The information provided on this form will be
processed by the Scottish Environment Protection Agency ("SEPA") to
process and assess your application for registration, to monitor
compliance with the relevant conditions, to process renewals, and
for maintaining the relevant public register(s).
We may also process and/or
disclose it in connection with the following:
- offering/providing you with our literature/services relating to
environmental affairs
- carrying out statistical analysis, research and development on
environmental issues
- providing public register information to enquirers
- investigating possible breaches of environmental law and taking
any resulting action
- preventing breaches of environmental law; and improving our
service.
We may disclose the information to the public, public bodies and
other organisations (e.g. Health and Safety Executive, Local
Authorities, Emergency Services, Scottish Executive) when
consulting on environmental issues.

should contact SEPA before submission of your application.
