How to apply for, vary or transfer an authorisation

Depending on the nature of your activity and the level of authorisation you require, you can apply for, vary or modify an authorisation online or by post.

Before embarking on any application process, we strongly advise that you contact us in the first instance.

This should help you get your application right first time and raise issues early, ultimately saving you time and money.

How to apply for a new authorisation

(a) Find out if your activity requires authorisation

You can access guidance relevant to your activity or contact us to determine whether or not your activity is subject to regulation.

(b) Establish the cost of your application

Our charging schemes will advise on the estimated cost of your application and advise whether or not a subsistence (annual) fee applies.

(c) Complete your application form before returning it to us via email or by post

Certain applications can be made online but all applications can be submitted via email or post. Please contact us to confirm how to apply.

We have 30 to 60 days to assess an application for registration and four months for a licence.

During this time, we may ask for more information from the applicant, request that they advertise their proposals publicly or make provision for public consultation and feedback.

If this is necessary, the response time period may be paused but we may also request an extension to the determination period if necessary.

How to vary or modify an existing authorisation

You can vary or modify an existing authorisation by altering the scope of the authorisation or by adding, removing or changing conditions.

This includes a range of scales of changes, from a request to make a relatively minor administrative change to a licence condition, to a substantial change in the scope of the licence to cover an additional or substantially changing activity.

When making an application to vary or modify an existing authorisation, you must ensure that the information requested is provided in sufficient detail.

This information must include clear details of the proposed changes and the possible implications on the surrounding environment – in some cases, this information must be presented in a format determined by us.

On receipt of your application, we may decide that we require more information, to be provided by service of notice.

We are allowed set periods of time to respond to an application to vary or modify an authorisation, as detailed in the table below.

Radioactive substances registration and non-nuclear authorisation

4 months

If no decision has been made by us during the period allowed, the application will be deemed refused unless an extension has been agreed

How to transfer an existing authorisation

An application to transfer an authorisation may be made if, for example, the company holding the authorisation is sold or if a similar situation arises.

In order to transfer an authorisation, you must submit an application, co-signed by both the existing authorisation holder and new authorisation holder, to us.

As part of the transfer process, we may be required to confirm if the proposed holder is able to meet certain requirements before accepting the transfer. This may, for example, mean being able to demonstrate that the proposed holder is able to secure compliance with the conditions of the licence. The tests which are applied during this determination vary across regimes.
